Who qualifies
This is the Non-Immigrant O visa route for the foreign husband or wife of a Thai citizen β a legally registered marriage, either done at a Thai district office or married abroad and properly legalised in Thailand. Since Thailand's Marriage Equality Act took effect in January 2025, a same-sex spouse legally married to a Thai citizen has exactly the same right to this visa as any other spouse.
The financial requirement
You need to meet one of two thresholds: 400,000 baht held in a Thai bank account, or a monthly income of at least 40,000 baht. The two can also be combined proportionally β say 200,000 baht in the bank plus 20,000 baht/month. The bank deposit needs to have been sitting there for at least 2 months before your first application, and 3 months before each annual renewal β a sudden top-up right before applying is a common reason for rejection.
How the process actually works
You typically enter on a 90-day Non-Immigrant O visa first, then convert it to a 1-year extension of stay based on marriage once you're at immigration in Thailand. Since January 2025, the initial Non-O application can be done online through Thailand's e-Visa portal rather than requiring an in-person embassy visit.
